It is with great joy that we note the recent rejection by the Swiss Federal Supreme Court of the appeal against the judgment of the Bernese High Court of Autumn 2024.

We are pleased to announce that on 4 December 2024, PANArt received a new confirmation of copyright on the hang from Colmar, France. It applies not only to France, but also to Italy, Germany, the Netherlands, Spain and Ireland. In addition, the ruling contains information about which counterfeits are likely to infringe the rights of authors Sabina Schärer and Felix Rohner.
In the wake of the latest HCU-newsletter, we feel compelled to contribute a few clarifying sentences to the discussion about the Bernese judgement, which impressively confirmed the copyright protection of the Hang for Switzerland, Germany and the Netherlands.
The European Union Intellectual Property Office (EUIPO) has made its decision.

The Supreme Court of the Canton of Berne (Switzerland), on July 2, 2024 handed down the long awaited decision in the proceedings initiated by 25 manufacturers and dealers of handpans (“Claimants”) in October 2020. The Court, in its thorough decision of 95 pages, held that the HANG, in all its versions, and as shown in the sketch below, is protected by copyright under Swiss law, under German law and under Dutch law.
In the event of damage
We only tune the Hang® Balu, Hang® Bal, Hang Gubal® and Hang® Sculptures from owners who have entered into an agreement against speculation with us. Hang® sculptures include the Integral Hang® and the Free Integral Hang®.
Subsequent owners of these instruments are only eligible to have their instruments repaired if the agreement was taken over correctly from the original buyer.

The Commercial Court of the Canton of Bern had scheduled the main hearing for two days, and it indeed lasted that long – unusually long for a court hearing in Switzerland. The courtroom was filled to capacity.

Last May the plaintiffs handed their reply to the court. We now have responded to this reply. This closes the written procedure, and the commercial court of the Canton of Bern (Switzerland) is expected to summon the parties to the main hearing in the beginning of 2023. Thus, we hope for a final decision regarding the copyright protection of the HANG in 2023.

In this dissertation Christopher Baron, a formed music therapist, goes deep into the effects that music produced with the PANArt Hang®-Family Instruments on musicians.
The Hang Balu enables a musical exchange in a collective, far away from expectations and pressure to perform. The Balu instruments offer themselves as a common denominator, as a universal language to which everyone has access. If you play collectively, you only need a small contribution from the individual player to create a complex network of sounds together — always carried by the pulse, the bass.

A contribution to clarification

A design must be registered before a public presentation of an object. PANArt did not do this with the famous Hang sound sculpture. In certain countries, however, copyright protection applies, for example in Switzerland.
We present you an insight to the development of our instruments made with Pang composite which has an inner energy higher than steel. A challenge.

The Hang® Godo is a hand played percussion instrument. It does not only represent a percussive challenge, but also requires players with ears for melodic bass pulses. The pulses of the Helmholtz resonance are surprisingly strong and can be used in a variety of muscial styles.

The Hang® Gudu is a talking pot which requires nimble hands. This happily chattering vessel calls for soul-infused playing, which embeds it in the pulse of the Urgu or the Gubal. It also easily finds its place in many conventional instrumental ensembles. Mastery of the Hang® Gudu will make learning how to play the Gubal and Urgu easier.

The Gubal shown here has only been built by PANArt in isolated cases since 2019.
The PANArt tuners have continued to work on the lenticular shape in the past years and have created the Hang Balu, an instrument that is already actively played by several groups.
The Hang Balu returns to the lenticular form of the "classical" sound sculpture Hang, with its cathedral effect coming very close to its sound world, but with its pulse character it represents an important further development to collective playing.

In 1976 the steelpan arrived in Bern. In 2016 PANArt introduced the Hang Bal. From the “round the neck” steelband via the Hang to the “round the shoulder” Hang Bal Spiel.

The Trinidadian people gave a gift to the world: the sweet sound of steel. Each individual has to find out what is meant by this gift. You have to live it, to eat it, do digest it. In 1994 the steel orchestra Original Bernese Oil Company organized the first international Panyard in Europe. It was an insight into the nature of this gift from Trinidad, into the nature of human beings. This is a glimpse of the closing party. Enjoy!

The Hang® Urgu offers a strong pulse-like bass (78 Hertz/Eb2) and a rich percussive palette. The bass can be lowered by up to one octave by varying the hand's position in the Gu opening. Its ringding is tuned to an Eb chord and serves a double function: a sound source as well as a place to excite the air which produces the bass.

In 1989 I made a steelpan out of an barrel from 1979. This old barrel, aged under the Hungarian sun, produced a wonderful warm sound, much better than the sound from a fresh new barrel from the drum factory. This was the beginning of a long period of research that led us to the Pang® composite, an artificial aged metal.

These have come together to form the Pang ensemble. The creative path has led us away from the sound sculpture Hang, and towards Pang’s other potentialities: instruments whose bodies can also bring forth a driving, pulsating bass.

The Hang® Gudu is a hand played percussion instrument.
The high quality of Pang®, a composite material developed by PANArt, gives the instrument very good tuning stability as well as protection against corrosion.
PANArt's art of tuning is apparent in the harmonic interplay of the prestressed and tuned vessel with the air resonance in its cavity. The frequency of the air resonance is 155 Hertz. This pitch can be altered by hand.

After the inebriant sounds of the Hang the Pang steel sheet has undergone a deep transformation into the Gubal wich is now unleashing a pulsing bass. This instrument is now suitable for playing together. But with whom? The traditional instruments are in general considerably louder and have purer tuning than the Gubal, wich renders playing together rather difficult. On searching for a suitable solution for this problem we had the idea of building those instruments ourselves: the Pang string instruments Pang Sei, Pang Sai and Pang Sui were born.
